Terms of Service
Last updated: October 19, 2026
These terms govern your access to and use of SwishDone. They cover accounts and workspaces, customer responsibilities, integrations, acceptable use, fees, and liability.
1. Acceptance of these terms
These Terms of Service ("Terms") govern your access to and use of the SwishDone website and platform. By using the service, requesting a presentation, or creating an account, you agree to these Terms. If you use the service on behalf of a business, you represent that you are authorized to bind that business.
If you do not agree to these Terms, do not use the service.
2. The service
SwishDone connects existing advertising campaigns to lead qualification, follow-up, self-service scheduling, a unified communication timeline, and conversion reporting. The service is designed to support the work around calls and meetings, not to replace your advertising platform, telephone system, calendar, or construction-management software.
The service depends on third-party providers. Features may change, and some capabilities may be unavailable until the relevant provider is connected and approved for live use.
3. Accounts and workspaces
- You must provide accurate account information and keep it up to date.
- You are responsible for safeguarding your credentials and for activity under your account.
- A workspace represents one marketed business. You may create or join multiple workspaces according to the permissions you are granted.
- Owners and administrators control membership, roles, and access. You must remove access promptly when it is no longer appropriate.
- You must notify us promptly if you suspect unauthorized access.
4. Customer data and responsibilities
You retain ownership of the data you submit to SwishDone. You grant us the rights needed to host, process, transmit, and display that data to provide the service.
You are responsible for the legality of your data and your outreach. This includes providing required privacy notices, obtaining valid consent, honoring opt-outs and quiet hours, maintaining accurate suppression lists, and complying with applicable advertising, calling, and messaging laws such as TCPA and carrier registration requirements.
You must not use SwishDone to send unlawful, misleading, or unsolicited messages, or to contact people who have asked not to be contacted.
5. Acceptable use
- Do not violate any law or the rights of others.
- Do not attempt to access another workspace, bypass permissions, or probe the security of the service.
- Do not reverse engineer, scrape, overload, or interfere with the service, except as permitted by law.
- Do not upload malware or use the service to distribute spam or unlawful content.
- Do not misrepresent your identity, your business, or the origin of a message.
- Do not use the service to make automated voice calls or to impersonate a person.
We may suspend or limit access to protect the service, our customers, or third parties.
6. Third-party integrations
SwishDone connects to third-party services such as Meta, Google Calendar, Quo, and email providers. Your use of those services is governed by their own terms and privacy policies. You are responsible for having the right to connect each account and for the costs, permissions, and compliance requirements that apply to it.
We are not responsible for third-party outages, policy changes, or data practices. Some features depend on provider approval and may be limited until that approval is granted.
7. Fees and payment
SwishDone is offered under a tailored quote. Pricing, billing period, and included services are set out in the proposal or order form we provide to you. Unless stated otherwise, fees are exclusive of taxes and are payable as described in the order form.
We may change pricing for a future renewal period with reasonable notice. Failure to pay may result in suspension of the service.
8. Intellectual property
SwishDone and its licensors own the platform, software, design, documentation, and trademarks. We grant you a limited, non-exclusive, non-transferable right to use the service during your subscription, subject to these Terms.
You retain ownership of your data and your brand materials. If you provide feedback, you grant us a non-exclusive right to use it to improve the service without obligation to you.
9. Confidentiality
Each party may receive confidential information from the other. The receiving party will use it only to perform under these Terms, protect it with reasonable care, and disclose it only to personnel and advisers who need to know it. Confidentiality obligations do not apply to information that is public, independently developed, or required to be disclosed by law.
10. Disclaimers
The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee any specific number of leads, appointments, conversions, revenue, or return on advertising spend. Provider data, attribution, and reporting depend on third-party systems and may be incomplete or delayed.
11. Limitation of liability
To the maximum extent permitted by law, SwishDone will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim arising out of or relating to the service will not exceed the amount you paid to us for the service in the twelve months before the event giving rise to the claim, or one hundred US dollars if no amount was paid.
Some jurisdictions do not allow certain limitations, so part of this section may not apply to you.
12. Indemnification
You will defend and indemnify SwishDone against claims, damages, and costs arising from your data, your outreach, your violation of these Terms, or your violation of another person's rights, including privacy, marketing, and messaging laws.
13. Suspension and termination
You may stop using the service at any time. We may suspend or terminate access if you materially breach these Terms, fail to pay, create risk for the service or others, or if required by law. Where reasonable, we will give notice and an opportunity to cure.
On termination, your right to use the service ends. We will make your data available for export for a reasonable period where required by the agreement, after which we may delete it.
14. Governing law and disputes
These Terms are governed by the laws applicable to the SwishDone entity that provides the service to you, without regard to conflict-of-law rules. Any dispute will be brought in the courts located in that entity's principal place of business, unless applicable law requires otherwise. Before filing a claim, both parties agree to attempt to resolve the dispute in good faith.
15. Changes to these terms
We may update these Terms as the service evolves. We will post the updated version on this page and change the "Last updated" date. If a change is material, we will provide additional notice where appropriate. Continued use after the effective date means you accept the updated Terms.
